COAI to move SC on WLL

Cellular Operators Association of India is believed to have decided to approach the Supreme Court on the issue of wireless in local loop.

According to cellular industry sources, COAI's executive council recently decided to move the apex court, against TDSAT's earlier judgement, dated August 8, which had permitted basic operators to offer WLL services.The timing for approaching SC has not yet been finalised, sources added.
"This decision of COAI executive council is independent of today's TDSAT judgement on technology to be used for WLL services," cellular sources pointed out.
The decision comes a month after TDSAT dismissed a petition by cellular operators challenging government's decision to allow basic operators to offer WLL limited mobile services.
"We have seen no illegality or arbitrariness in either the procedures followed or, the final decision taken by the government to permit basic service operator to provide limited mobility services as a value added service within the ambit of their license," the order had said.
The TDSAT majority order had said that allowing WLL limited mobility in basic service stream did not go against the spirit of the New Telecom Policy, 1999.
The judgement had, however, pointed out that introduction of limited mobility services had disturbed the level playing conditions and hence suggested a number of steps to address this issue.
